A lawsuit was recently filed in the Palm Beach County Circuit Court by the association that manages The Lucerne, a condominium complex located in Lake Worth, Florida.
The association is suing the complex’s developer, claiming the company’s work does not comply with building codes, and that the majority of the work is shoddy, the Palm Beach Post reports.
The lawsuit was filed on May 13, which states that the developer, The Weitz Company, and the complex’s architect, Marc Wiener, are liable for the building code failures. In addition, the complex, which is six stories high and as 80 units, has experienced multiple cases of leaking windows, poor drainage in the pool equipment room, cracked stucco on the perimeter walls and more. The association also discovered that several elevators are not connected directly to an emergency power source and thus, would not be able to move if a power failure occurred.
Furthermore, the case claims the defendant failed to pay more than $58,000 due to the association, based on audited financial statements. In addition to these funds, the association is seeking the full amount necessary to make repairs to the aforementioned areas.
The association first took over the complex in May 2007. The vice president of the owner’s association told the news source that the group is making “sure we’re legally protecting the owners’ investments.”
