Tennessee property owners sue architect for leaks

The owner of a condominium complex in downtown Nashville, Tennessee, has sued an architectural firm which worked on the building over structural flaws.

Multiple sources say the owner of the Icon in the Gulch complex in downtown Nashville has filed a lawsuit against KA – an architectural firm based in Cleveland, Ohio, for issues with the 417-unit building.

The suit alleges that problems with the building’s design have allowed water to get inside and created designs which don’t comply with local codes and rules. The firm in question was contracted in 2006 for the project.

The case highlights the need for architects to have professional liability insurance, which can help pay for legal fees in the event of a lawsuit.

The Nashville Business Journal reports that the developers have spent approximately $500,000 to identify the fix all of the deficiencies in the building. The plaintiff added that a neighboring building, the Terrazzo, may also be suffering from similar issues.

Some local residents also told the Tennessean that the building owners’ decision to rent some units and sell off others for reduced prices has failed to deliver on claims that the development would be “upscale.”
